General Terms and Conditions for the ISK e. V. Hannover language school
Section 1 Application
These General Terms and Conditions apply to all language courses, examinations and service packages provided by ISK e.V. Hannover (hereinafter referred to as ISK) that you book with us. The prices are those set out in the current ISK price list, and in force at the time of registration. And, for courses receiving public funding, the specific provisions of the funding body apply.
Section 2 Registration
- Registration for courses, examinations or service packages must be made either in writing at our office in Hanover or online via the Registration section of our website.
- A contract is formed when ISK confirms a booking in writing or by email.
Section 3 Terms of payment
1. Due date: Following confirmation (Section 2.2), ISK will issue an invoice to the contracting
party. Fees are payable before the course commences or before any services under the
service package are provided.
2. Methods of payment: Course fees may be paid by bank transfer or (by card or in cash) in
person at our office.
3. Payment by instalments: Payment by instalments may be arranged by prior agreement
before commencement of the course. In such cases, the parties will enter into a written
agreement specifying the instalment amounts, payment schedule, duration and any other
relevant terms.
Section 4 Transfers
- Transfers to another course may be made, provided the course originally booked has not yet commenced. An administration fee of €50.00 is payable for any transferred booking.
- A transfer is subject to the availability of places on the requested course.
Section 5 Cancellation by the participant
A booked course may be cancelled before it commences. Cancellation must be made in writing. The following conditions apply:
- Cancellation deadlines and fees:
- More than four (4) weeks before course commencement: €150 cancellation fee
- Between four (4) and two (2) weeks before course commencement: €250 cancellation fee
- Less than two (2) weeks before course commencement: the full course fee is payable
- Participants reserve the right to prove that ISK has incurred no loss, or a loss lower than the fixed cancellation charge that is levied.
- Non-attendance / leaving the course before completion: No refund will be given if a participant fails to attend or withdraws from the course after it has commenced.
- Service packages: As our service packages are offered at preferential rates, these cannot be cancelled once services under the package have commenced, and no partial refunds will be given for individual course components.
- Visa applications: Cancellation is possible only upon presentation of the original visa refusal letter issued by the embassy. If a participant cancels, or leaves the course before completion, any certificates issued by ISK for the purpose of obtaining a visa will become invalid with immediate effect.
- Notification obligation: In the event that the participant cancels, transfers a booking, leaves the course before completion or fails to attend it, ISK reserves the right to notify the relevant immigration authority or embassy without delay.
- Examinations: Once the registration deadline has passed, cancellation of the examination booking is no longer possible.
Section 6 Course schedule
A lesson lasts 45 minutes. Courses are held on the dates and at the times announced in advance. Unless otherwise stated, no lessons will be held on public holidays in Lower Saxony. If a lesson is cancelled due to circumstances for which ISK is responsible (e.g. illness of the teacher), a replacement lesson will be provided. If a lesson is cancelled due to circumstances for which the participant is responsible, no replacement lesson will be provided. ISK reserves the right to combine courses for educational or organisational reasons.
Section 7 Data collection
Personal data are collected and processed solely for the purpose of administering the contract and in compliance with the General Data Protection Regulation (GDPR). Further details can be found in the Privacy Policy on our website.
Section 8 Insurance cover
The course fee does not include insurance cover. Participants are responsible for arranging their own appropriate insurance cover (e.g. health, accident and personal liability insurance).
Section 9 Liability
ISK accepts no liability for accidents, personal injury, damage to property, or the loss of clothing or valuables. This exclusion of liability does not apply in cases of wilful misconduct, gross negligence, or death or personal injury.
Section 10 Right of withdrawal
A statutory right of withdrawal applies only to consumers in respect of contracts entered into solely by means of distance communication (e.g. online registration, email or telephone) or away from the business premises of ISK. There is no statutory right of withdrawal if the participant registers, and signs the contract, in person at our business premises.
Consequences of withdrawal: You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the date on which the contract is entered into.
To exercise your right of withdrawal, you must inform us (ISK e.V., Lützowstraße 7, 30159 Hannover, Germany, Telephone: +49 511 12365360, email: office@isk-hannover.de) of your decision to withdraw from this contract by making a clear statement (e.g. a letter sent by post or an email). Alternatively, you may exercise your right of withdrawal by completing the withdrawal form provided on our website and submitting it electronically.
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and, in any event, no later than fourteen days from the day on which we receive your notice of withdrawal from this contract. We will make this reimbursement using the same means of payment that you used for the original transaction, unless the parties have expressly agreed otherwise. In no event will you incur any fees as a result of this reimbursement. If you have requested that the services commence during the withdrawal period, you must pay us an appropriate amount. This amount must be in proportion to the services already provided up to the time you informed us of your decision to exercise your right of withdrawal in respect of this contract, relative to the total services provided for under the contract.
